  COMBINED NOTICE NOTICE OF FINDING OF NO SIGNIFICANT IMPACT ON THE ENVIRONMENT AND NOTICE TO PUBLIC OF REQUEST FOR RELEASE OF FUNDS. Date of Publication: Nov 12, 2009 Name of Contractor: City of Reno Address: 195 W. Reno Road Telephone Number: (817) 221-2500 Contract No.: 729659 This Notice shall satisfy the above-cited two separate but related procedural notification requirements. REQUEST FOR RELEASE OF FUNDS On or about seventeen (17) days following the above date of publication, the above named municipality will submit a request to the Texas Department of Rural Affairs for the release of Texas Community Development Program funds under Title I of the Housing and Community Development Act of 1974, (P.L. 93-383), to undertake a project named City of Reno water project. Purpose of Project: Provide water system improvements Description of Project: Construct water well; disinfect ground storage tank; install new high service pumps; install new water line: replace existing meter vault; and install additional meter vault. Locations of Project Well: S. side of Rhonda Rd., approx. 1,000 ft. W. of Boyd Rd.; Azle Connection/Vault-Reno Rd. and Boyd Rd.; Water Line-Harris Lane, Miller Rd., S. approx 3,300’; Springtown Connection /Vault - Harris Lane, approx. 1,000 N. of Nelson Rd.; Springtown Connection/Elimination - Quail Run and Jack Roy Rd. Enumeration District/Cenus Tract: Citywide Estimated Cost of Project: $385,000.00 FINDING OF NO SIGNIFICANT IMPACT The City of Reno has determined that the project will have no significant impact on the human environment. Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required. Additional project information is contained in the Environmental Review Records (ERR) on file at City Hall, 195 W. Reno Road, Azle, Texas 76020 and may be examined or copied weekdays during regular business hours. PUBLIC COMMENTS ON FINDINGS All interested agencies, groups and persons disagreeing with this decision are invited to submit written comments for consideration by the City of Reno to City Hall on or before seventen (17) days following date of publication. All such written comments so received will be considered and the City of Reno will not request the release of Federal funds or take any administrative action on the within project prior to the date specified in the preceding sentence. Commentors should specify which part of this Notice they are addressing. RELEASE OF FUNDS The City of Reno certifies to Texas Department of Rural Affairs that Roen Cox in the official capacity as Mayor consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. Texas Department of Rural Affairs’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities, and allows the City of Reno to use Program funds. OBJECTION TO RELEASE OF FUNDS Texas Department of Rural Affairs will consider objections to its release of funds and the City of Reno’s certification received within thirty-three (33) days of publication of this notice or a period of fifteen days from its receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer or other officer of the City of Reno approved by Texas Department of Rural Affairs; (b) the (RE) has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR Part 58; (c) the grant recipient or other participants in the project have committed funds or incurred costs not authorized by 24 CFR Part 58 before approval of a release of funds by Texas Department of Rural Affairs or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58) and shall be addressed to Texas Department of Rural Affairs, P.O. Box 12877, Austin, Texas 78711. Potential objectors should contact the Texas Department of Rural Affairs to verify the actual last day of the objection period. Certifying Official: Roen Cox, Mayor.

The City Council of the City of Azle will conduct a public hearing at 7:00 p.m. on December 1, 2009 in the City Council Chambers at City Hall, located at 613 Southeast Parkway to consider an ordinance approving a Specific Use Permit for the drilling and operation of a gas well for property described as a 119.897 acre tract of land, more or less out of the W. H. H. Moore Survey, Abstract 1938 and the William Lawrence Survey, Abstract 974, Tarrant County Texas. The gas well pad site is located approximately 700 feet from the north side of Stribling Drive.
